TERMS & CONDITIONS OF VILLA SUN & SEA

The Owners of the Property will be very grateful to you for observing these Terms and Conditions, which are intended to ensure a peaceful and safe stay for all our Guests.

TENANT - a natural or legal person having the capacity to perform legal acts within the meaning of the provisions of the Civil Code, being a party to the Agreement on the temporary use of the Apartment.

APARTMENT - luxury bungalows and villa rented to the Tenant for a temporary stay for recreation or tourism, located in 21224 Slatine, Bana Jelacica 76, Croatia.

LESSOR - SUN AND SEA j.d.o.o. (hereinafter referred to as Villa Sun and Sea), located at 21224 Slatine, Bana Jelacica 76, Croatia.

§1 Introduction

These terms and conditions specify the rules for booking and renting apartments and the rules for using the infrastructure of the Facility.
The Facility provides accommodation services in accordance with its business profile.
The description of the apartments and the price list can be found on the official website of the facility. The prices in the price list include VAT and tourist tax.
The terms and conditions an integral part of the contract, which is concluded by making a reservation and payment of an advance or the entire amount due for the stay in the apartment.
By making the above-mentioned actions, the Guest confirms that he/she is familiar with and accepts the Terms and Conditions.

§ 2 Booking, terms of payment, deposit

Booking must be made on the website www.villasunandsea.eu, by email to: info@villasunandsea.eu or by phone at +385 99 470 3010.
The condition for the confirmation of the booking is the payment of an advance in the amount of 30% of the Agreement value in cash or by bank transfer to the indicated bank account of the Lessor.
Confirmation of the booking shall take place on the day of crediting the bank account with the required advance payment and shall constitute a Rental Agreement which shall enter into force upon payment of the required advance payment.
The payment of the remaining part of the Agreement shall be made no later than on the day of commencement of the stay in cash or by transfer to the indicated bank account of the Lessor.
On the first day of the stay the Lessor shall charge a refundable deposit in the amount of 300 EUR as a security in the event of the necessity to cover losses related to the removal of possible defects, damage arising in the rental object as a result of the Tenant's action or omission or losses related to a breach of security by unjustified activation of the fire protection system and in connection with possible loss of the keys - the material value shall be determined by the Lessor. Should the cost of rectifying the defects or damage be higher than the value of the collected deposit, the Tenant shall be obliged to cover all the costs, including both the actual damage and the lost profits, which Villa Sun and Sea could have obtained if the defects or damage had not occurred. The deposit referred to above will be returned to the Tenant on the last day of their stay in the event that the Apartment is handed over in an undamaged condition.
The Tenant may cancel the reservation by phone or by e-mail to the specified e-mail address. In case of cancellation or withdrawal from the Agreement (no-show), the deposit paid is lost and non-refundable. It is possible to change the date of booking only with the consent of Villa Sun and Sea, if the same or an apartment of a similar standard is available at the new appointed date without additional costs. Rescheduling is not possible if it concerns the high season (vacations, New Year's Eve, long weekends). Villa Sun and Sea may cancel or change the booking only in case of occurrence of fortuitous events beyond the Lessor's control, the consequences of which cannot be immediately removed by usual means, by providing another substitute Apartment of a similar standard in the same location, or by providing another possible date of stay. In the case of the Tenant's lack of consent to change the reservation, the Lessor in the event of force majeure has the right to withdraw from the Agreement. This also applies in cases in which the personal safety of the Tenant or their property cannot be guaranteed for reasons beyond the control of the Lessor. In this case the amounts paid by the Tenant shall be refunded immediately, with a deduction of the amounts due to the Lessor for services already rendered. In the case of a later arrival or earlier departure, Villa Sun and Sea shall not reimburse the costs for the unused stay.

§ 3 Conditions of stay

During the check-in you should show a valid identity document - an ID card or passport.
The billing unit is a hotel day. Check-in starts from 14:00 on the day of arrival and ends by 10:00 on the day of departure. On special request, Villa Sun and Sea may lengthen (but not shorten) the hotel day - depending on the availability of the apartment.
The apartment can not accommodate more people than reported in the reservation process (Bungalow 1 – max. 4 people, Bungalow 2 and 3 – max. 5 people, Apartment 1 – max. 8 people). In the case of the arrival of more people than reported during the booking, Villa Sun and Sea reserves the right to terminate the contract and retain the prepayment.
The guests who are not registered are not allowed to stay in the property as registered guests.
The facility enforces quietness at night from 10 p.m. to 6 a.m. The Lessor may refuse to provide further services to persons who violate this rule.
Villa Sun and Sea asks our Guests to respect the principles of good neighbourhood, not to disturb the peace and well-being of other Guests, observing the commonly applied norms of coexistence between people.
Facility owners are not responsible for any damage to the health of our guests.
Tenant is obliged to take care of the rented apartment and its equipment, leaving them in a state not deteriorated.
Children under 14 years of age can stay on the premises only under the constant supervision of legal guardians.
Due to fire safety is prohibited to use heaters, electric irons and other similar devices in rooms, which are not equipment of the apartment.
The apartments are completely non-smoking. Smoking is possible outside the Apartments only in places designated for this purpose. In case of activation of the alarm system caused by smoking in the Apartment, the Tenant will be charged a fee of 100 euros.
For the sake of comfort of all guests Villa Sun and Sea cordially invites you without pets, reptiles, amphibians and other animals.
During their absence, the Tenant is required to secure the apartment by closing the windows and doors, turning off the appliances that may pose a fire hazard. Villa Sun and Sea is not responsible for the loss of or damage to the Tenant's property.
Items left in the Apartments by departing Guests, at the request of the Guest will be sent at the expense of the recipient to the address indicated. In the absence of such a disposition, Villa Sun and Sea will store the items for a period of 1 month. After this time, the items left behind will be thrown away. 14. The Tenant is obliged to immediately inform the reception staff about any loss of keys to the apartment or any damage done to it.
Villa Sun and Sea provides free parking on the premises, but the Lessor is not responsible for damage or theft of a car or other vehicle belonging to the Tenant.
Villa Sun and Sea may refuse to accept a Guest who grossly violated the rules during the previous stay.
In the case of a gross violation of the conditions of stay, Villa Sun and Sea has the right to withdraw from the Agreement with immediate effect and remove the Tenant and accompanying persons from the Apartment without refund.

§ 4 Obligations of the Facility

The Villa Sun and Sea provides services according to its category and standard. In case of any reservations concerning the quality of services, the Guest is requested to report them immediately at the Reception in order to provide an immediate response. Information on the way of filing a consumer complaint is available in each apartment.
The Villa Sun and Sea is obliged to provide:
1. Conditions for full and unrestricted rest of Guests,
2. Safety of keeping the Guest's information confidential,
3. Professional and courteous service in all the services provided,
4. Cleaning of the apartment every 5 days,
5. Efficient service in terms of technology,
6. Change of towels every 3 days.

§ 5 GDPR

Zgodnie z art. 13 Rozporządzenie Parlamentu Europejskiego i Rady (UE) 2016/679 z 27.04.2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych) (Dz.Urz. UE L 119) informuję, iż:

Pursuant to Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the EU L 119), I inform you that:

The administrator of the client's personal data is Villa Sun and Sea. Villa Sun and Sea undertakes to process the data of its Tenants as part of the activities related to the performance of the Agreement and to protect them against access, use, deletion, or disclosure to third parties, as well as to process the entrusted data in a manner consistent with applicable law in a manner that guarantees the confidentiality and security of personal data.
Tenant's personal data will be processed in order to use the hotel services (on the basis of Article. 6.1.b) - processing is necessary for the execution of the Agreement to which the data subject is a party, or to take action at the request of the data subject before entering into the Agreement.
Tenant agrees to the processing of personal data such as: name and surname, address, identity card data, contact telephone number, e-mail, and possibly the data of his business necessary to issue an invoice, in order to: sign the Rental Agreement, i.e., make a reservation and check in at the Facility, issue and store invoices.
Recipients of the Tenant's Personal Data shall only be entities entitled to obtain personal data on the basis of the law and entities participating in the implementation of services.
Tenant agrees to provide his/her personal data to the employees of the Reception of the Facility in order to properly operate our Services for use.
Tenant agrees to the transfer of his/her data to the Villa Sun and Sea accounting.
Tenant's personal data will be stored for a period of 10 years.
Tenant has the right to request access to personal data from the administrator, the right to rectify, delete or restrict processing and the right to data transfer.
Tenant has the right to lodge a complaint to the supervisory authority.

10. Providing personal data is voluntary, but the refusal to provide data may result in refusal of the Service.

§ 6 Final provisions

Matters not covered by these Terms and Conditions shall be governed by the provisions of the Civil Code.
Information on changes to the Terms and Conditions will be given no later than three calendar days before the change comes into force.
